Legislative Bulletin April 8, 2008 House Bill 488aa pulled from House Calendar. Dear Friends of Midwives,
First of all, I want to thank you all from the bottom of my heart for all of the phone calls, emails, and letters to your legislators. Our bill was the talk of Capitol Hill this year. The legislators were very impressed by our grassroots efforts and how polite we were in our correspondences.
I feel very confident that this bill will go through next year. We have made tremendous progress with our legislators. Please give yourselves all a big pat on the back. You made a difference!
I would like to clarify for everyone, why we pulled the bill back to committee. It was brought to our attention that we had left out the definition of midwifery. What we did say in the bill was that 'midwifery is not the practice of medicine, nursing, or nurse-midwifery.' But, we did not say what it was either. So, the Attorney General's office basically said that if the bill was challenged in a court of law, (Which would not be uncharacteristic of the Idaho Medical Assoc.), the definition of midwifery would be decided by the courts. It could be defined from a dictionary, from the World Health Organization, or from Utah's law. We decided that in order to maintain our integrity with the legislators, we would pull the bill and bring it back next year with flawless language.
This will also give us the opportunity to make some of our legislative opponents happy by us once again saying that we tried to work with the IMA. Rep. McGeachin is going to set up meetings with them and some of the other bill supporters to see if they will really be willing to compromise. (Which we all know they won't!) This will give us the opportunity to go back next year and say, 'Look we tried again and here are all the changes we made to make the IMA happy, but they will never like this bill.' Most of our supporters already know that they will never be happy because we are a competing profession. I anticipate, however, that it will give us more credibility with some legislators.
Speaking of legislators, we are going to send out a 'Legislative Survey' to all the legislators that are running for office. We need to know who is going to support us and who is not. Then, we need to carefully consider supporting the legislators in our districts that are behind our birthing choices. In the next few months, please stay connected as we will need you to become politically active in your own districts. There will be some new candidates that we may wish to support that would really be supportive of Idahoans for Midwives and the families represented by this organization.

Legislative Bulletin, March 6, 2008 Third Reading Friday, March 7. Debate and Vote on Monday, March 10.

Tomorrow (March 7), HB 488 will be heard on the floor of the House for the third time. The debate and vote will be on Monday, March 10.
Monday will be a big day for us and will determine whether our bill will move onto the Senate.
Please call Monday AM before 10:00AM and ask your Representatives to vote YES on this bill. (They will ask what district you live in, so have that handy). Every phone call makes a difference.

Next, we are moving onto the Senate and the IMA has already been working on them. We are asking you folks to start sending emails to the Senators, esp on the Health and Welfare Committee. We are going to keep the emails VERY short, sweet and fun. It would be fabulous if you would email a new message every day.

You can come up with your own, just keep it very friendly and sweet.
Then just a short little one or two liner asking for them to support the HB 488, the Midwifery Voluntary Licensure Bill.
Legislative Bulletin, March 3, 2008 Onto the House Floor, Facing Opposition
Tomorrow HB 488 will be heard on the floor of the House. We are expecting some Representatives who oppose the bill to attempt to add some amendments which would negate the entire bill. We can't let this happen. We need every person to email all the Representatives and ask them to support this bill. When you email your own Representatives, please tell them that you are their constituent.
Here is a sample letter that will help you get started:
Dear Representative-
As your constituent, I expect you to work for solutions for Idaho families to whatever current problems face them. We have a maternity care provider problem. Well trained, qualified Certified Professional Midwives are not able to obtain the potentially life-saving drugs they have the knowledge and experience to administer. We have a shortage of maternity care providers in our rural areas.
Idaho women and families will continue to choose midwives. You need to choose the solution.
Do not attach a negative or hostile amendment to HB 488.
Do not vote to allow “hostile” or negative amendments to be added to HB 488 with the intent to force the sponsors to let it die.
I am your constituent who will only be hurt if you do not protect my individual and parental right to choose the maternity care providers who best fits my individual needs, values, and priorities.
Unlike doctors, and hospitals, I do not profit from birth, nor do midwives who charge so much less (if anything at all) for their services.
If you participate in killing this bill, you choose to walk away from a solution for the citizens of Idaho. If you work to kill this bill, you are helping big business instead of those you are elected to serve.
You are my voice in this issue.
I want you to vote yes as they bill stands when it enters the floor of the House tomorrow from Committee.

Legislative Bulletin, Feb 28, 2008 A STEP FORWARD! Thanks to everyone for all your amazing calling, emailing and letter and note writing. YOU MADE A DIFFERENCE!!!
Today at 3:00pm HB 488 passed through committee by a vote of 9-3!
Descending votes were Rusche, Bilbao and Henbest.
Chew and Block joined us with the addition of amendments.
Last minute amendments were forced due to similar amendments passed in Utah yesterday. There is much sadness about two of these concessions, because while we knew they would come around eventually, we didn’t expect them so soon. Midwives were consulted and all knew this was a necessary move or the bill would die. Lost to Licensed Certified Professionals through this legislation are the care of women with twins and breeches.
Here is what is next for the weekend:
Please take a moment to thank all the committee members with emails or phone calls. They worked so hard for this legislation and are still working.

Representative Chew may need some more education on VBACs and why they must be allowed out-of-hospital birth, so please contact me if you are willing to meet with her or begin additional correspondence.
Utah lost a great deal of ground with regard to VBACs and we don’t want her to try to attach VBAC related amendments on the floor.
I am waiting to hear what is next beyond this, but I want to thank everyone for EVERYTHING you have done and ask you to please stay with us. We are moving onto the next step. Watch for future postings.

Legislative Bulletin, Feb 27, 2008 Hearing Update & A Call To Action Condensed version of yesterday's hearing:
There was a motion to create a study committee to iron out
differences - voted down
There was a motion to send the bill to the house floor for debate -
voted down 6-6
There was a motion to debate the bill in the Thursday H&W committee
closed meeting and a request for changes, amendments, and solutions
from both sides by that time - passed.
So that is where we are at. Michelle will meet with key Reps

Legislative Bulletin, Feb 21, 2008 House Health & Welfare Committee hearing of HB488
I have good news to share. The House Health & Welfare Committee Hearing for HB 488 started at 2:15 yesterday and ended at 6:00 pm. We overheard it was the most well-attended hearing of the 2008 legislative session to date. Staff brought in about 30 more chairs and we had standing room only.
The hearing was amazing and the tone was the polar opposite from last year, thanks in part to Madame Chair, Representative Block and our sponsor, Rep. McGeachin who, from the very beginning, made it clear that they would be requiring respect and decorum.
I wish I had a transcript to share with you all, because the testimonies were stunning and effective, but let me try to be brief as we now have much more to do. (I will try to send a brief synopsis of the testimonies later).
We went until 6:00 pm and everyone who wanted to testify was unable to do so we will continue next week, probably on Tuesday or Thursday. We will be needing more testimony and for it to be as strategic as that of yesterday. Our opposition is regrouping and will come out ready as well. We have heard that the hearing was the topic at department meetings of local doctors and they are pleading for their ranks to contact the legislators to oppose it. The impression of one friendly doc was that they are afraid if it gets out of committee, it will pass.
We made incredible progress yesterday thanks to all of our proponent testimonies and we owe such a debt of gratitude to all of you. THANK YOU for your generous commitment to this effort. Thank you for your amazing testimonies. YOU MADE A DIFFERENCE.
When I can, I will sit down and type out notes of the hearing. Until then, let me say we need the following from you:
Mothers and expectant Mothers or Fathers (without children—please do not be offended by this—we are simply trying to be as effective during that time as possible) to be at the Capital tomorrow with Michelle Bartlett who is staying to lobby. They are needed between 8:45 and noon. If you are available, that would be fantastic. Michelle is the lone unpaid lobbyist against a group of paid lobbyist there.
We need the emails and notes and push parties to continue. If you haven’t sent one of both kinds of correspondence, please do that now.
We need thank you cards and emails to go to Rep Janice McGeachin and Madame Chair, Rep Sharon Block for the hearing. Thank them for the obtaining the larger room and providing additional seating, for hearing those with babies and who came from out of town first, for setting and maintaining a respectful tone and for providing every opportunity for testimony on this very important legislation.
We need to know if you might be available to testify next week with the understanding that we are working closely with people on their testimonies. We had only powerfully positive and effective testimony yesterday whereas our opponents were repeatedly called on the carpet for inflammatory comments, and unsubstantiated data and claims.
Idahoans for Midwives needs financial support to keep be able to continue. Please consider a generous donation to Idahoans for Midwives to cover the costs that are being incurred to create materials and to keep Michelle Bartlett in Boise, bring Barb Rawlings in from Bonners Ferry and to bring POWER HITTERS like Utah CPM, Holly Richardson to testify. H&W Committee "print hearing" held
Today the House H&W committee held a closed "print hearing" where they agreed to print our bill. Now it will go to the printer, be assigned a house number and be available for everyone in the world to
see on the legislative website - www.legislature.idaho.gov. Next we will be given a hearing date with the House H&W committee where we
provide testimony. When it passes out of the committee it will be heard and debated on the floor of the House of Representatives. Once
it passes the House we go thru the same process on the Senate side.
Letters, phone calls, emails and meetings with your district
legislators and all those on the H&W committee are in order. I will email the bill number for everyone to reference in their
communications. Before that, just reference the Idaho Midwifery Voluntary Licensing Act. >We are off and running. We need everyone to do their part!

Bill Going To Committee This Week
The Idaho Midwifery Licensing bill will go into a closed hearing this Wednesday, February 6th, during which the legislative sponsors and
co-sponsors will introduce it to the House Health &Welfare Committee. Since this is a closed session, we are not invited to attend, and neither
is the opposition. After that introductory hearing, a date will be set for the public hearing. That will most likely happen the following week,but we
will let you know as soon as we know the date.
Beginning Wednesday, we need everyone to start sending an email or letter
to the House Health & Welfare committee members, asking them to support this bill. It is important that the letters be positive, concise, in your
own words and relatively short. They get a lot of email, and lengthy letters may not get read. Following is a sample email, but we encourage
you to do your own. (If they get a lot of "form letters," this could be counterproductive.)

Please vote YES on the Midwifery Licensure Bill. My name is _____________. I live in _____________.
My husband and I have chosen to have our babies at home with a Certified Professional Midwife, after carefully researching the issue. We decided
this option is better for our family. All of the major studies over the last 10 to 20 years have proven that planned births, whether at home, in a
birthing center, or in a hospital, attended by Certified Professional Midwives, are at least as safe as physician-attended hospital births. The
Midwifery Licensure Bill would make this option more easily available and more cost effective for us and for other Idaho families.
Our insurance will pay for a home birth, but only if the midwife is licensed. Many other states, including our neighboring states of Utah and
Oregon, already license CPMs. I know many other couples who would like to have this option in Idaho. I feel that it would be beneficial to the families in Idaho if we had another safe, cost-effective choice for maternity care.

Idahoans for Midwives supports a bill that will do the following:
Make available a license to Certified Professional Midwives using the CPM Credential.
- Give midwives the ability to choose to be licensed or not.
- Allow more families to utilize their heath insurance to cover maternity services.
- Give licensed midwives the ability to carry oxygen and other potentially life saving medications.
- Protects the rights of Idaho's women and families to safely and confidently choose their caregiver and place of birth.
- Licensure of the CPM would offer protection to Idaho physicians who collaborate with midwives and ensure that families
who choose out-of-hospital births will be provided with continuity of care when it becomes necessary
to consult or transfer to medical care.
